Brian Aitken Conviction Overturned!

Brian Aitken was arrested in New Jersey a few years back for being in possession of legally owned firearms, and hollow point ammo. Brian ended up being sentenced to seven years in prison under New Jersey’s ludicrous gun laws for being in possession of his own, legally owned firearms.

Yes, I typed that correctly. Here it is again : Brian was sentenced to seven years in prison under New Jersey’s ludicrous gun laws for being in possession of his own, legally owned firearms.

Brian’s handguns were LOCKED, and UNLOADED in the trunk of his car, where they were found by the gestapo police. He was arrested, and taken to jail for doing something that I do every day.

Anyways, Brian ended up serving some time in prison, after being convicted of at least two felonies, possibly three; I’m going off my memory here, so don’t take my word for it.

After serving some time, Brian was eventually released, after NJ Gov. Chris Christie signed a letter releasing him from prison. We were all very happy when Brian’s sentence was commuted, however he was still a convicted felon.

Until today.

I just hopped on Facebook, and noticed an update on the “Free Brian Aitken” Facebook page, with this message:

“Evan Nappen, Brian’s lawyer, says it best:

Today, we were able to reverse Brian Aitken’s conviction on appeal for handgun possession and large capacity magazine. The hollow point ammo charge was upheld, but we aren’t done yet. This creates a strange legal situation in which you can bring your guns to your new residence while moving, but not your ammo. So when you sell your house remember the buyer gets the refrigerator, the window treatments and your stash of hollow point ammo.”

This is great news! Brian, if you read this, I am very happy for you! I’ve never met you, and probably never will, but I feel as though I have gotten to know you a little since I began following your story. Congratulations!

It appears that I may have mis-spoken above, as it appears that the hollow-point ammo charge is a felony.

This article by http://www.courierpostonline.com, says “Aitken ‘will now be barred from possessing any firearms in the future.’ ” which leads me to believe that the hollow point charge is also a felony. That sucks.

I just got back from running some errands, while carrying a loaded Glock 19, with 30 rounds of hollow point bullets on my person. Perfectly legal here in NC, yet this poor sap has had his entire life messed up for having his guns locked, and unloaded in his car.

Its a sad state we are in folks. Those of you in NJ, and other liberty hating states, remember this in November. Vote for freedom.

  1. Living in Illinois, I can sympathized with Mr. Aitken when it comes to ludicrous gun laws!

  2. In New Jersey, law-abiding citizens are prohibited to own the most effective, safest, and time-tested ammo for lawful self-defense.

    But the POLICE all carry the EXACT ammo that is forbidden to the citizens.

    If hollowpoints are called "cop killer bullets" when a Citizen carries them (which is what they call them in NJ), then what does that imply they are when LEOs carry them–CITIZEN-KILLING bullets?

    Wake up, people. New Jersey is not a "state", it is a serfdom. Last time I looked, slavery was abolished in the US in by the 13th Amendment in 1865.

    I guess the New Jersey General Assembly didn't get the memo…

  3. Even in next door New York State (where it's hard to get a non-restricted lifetime, License to Carry a Pistol), one can carry "hollow points"!!
